The NSSMC establishes prudential standards and exercises prudential supervision over professional participants of capital markets and organized commodity markets within the scope of activities carried out by such a participant on the basis of a license. Professional participants in capital markets and organized commodity markets shall submit to the NSSMC information on the results of the calculation of prudential standards and the data on the basis of which they are calculated in accordance with the procedure and within the time limits established by the NSSMC Regulations. Prudential supervision in the capital markets and organized commodity markets ensures transparency and control over the activities of professional participants in the capital markets and organized commodity markets, and is an effective tool for protecting investors\u2019 interests.<\/p>\n
In connection with the introduction of martial law in Ukraine in accordance with the Decree of the President of Ukraine dated 24.02.2022 No. 64\/2022, in order to minimize the negative impact of the consequences of the military aggression of the russian federation against Ukraine and to promote the stability of capital markets, the NSSMC adopted Resolution No. 1221 dated 29.09. 2022 No. 1221 on Prudential Standards for Professional Activities in the Capital Markets and Organized Commodity Markets (hereinafter \u2013 Resolution No. 1221), which established that the asset liquidity ratio is used to measure and assess the risks of professional activities in the capital markets and organized commodity markets.<\/strong><\/p>\n Information on the results of the calculation of the asset liquidity ratio and the data on the basis of which the said indicator was calculated are submitted to the NSSMC in accordance with paragraph 6 of the NSSMC Resolution No. 314 dated April 23, 2022 on Submission of Reporting Data and Other Information to the National Securities and Stock Market Commission by Professional Participants of Capital Markets and Organized Commodity Markets During Martial Law (as amended) (hereinafter \u2013 Resolution No. 314).<\/p>\n Paragraph 6 of Resolution No. 314 stipulates that professional participants of capital markets and 7 organized commodity markets during the period of martial law shall submit to the NSSMC, as part of their reporting data, a certificate on the calculation of the asset liquidity ratio in accordance with the Annex to this Resolution<\/strong> no later than<\/p>\n the end of the fifteenth calendar day following the last day of each month of the reporting year;<\/p>\n the end of the third business day following the day on which the calculated value of the asset liquidity ratio for the first time in the reporting month became less than the regulatory value established by the NSSMC (submitted by investment firms, asset management companies and depository institutions).
