{"id":1172482,"date":"2020-07-02T10:06:06","date_gmt":"2020-07-02T07:06:06","guid":{"rendered":"https:\/\/www.nssmc.gov.ua\/?p=1172482"},"modified":"2020-07-03T14:12:00","modified_gmt":"2020-07-03T11:12:00","slug":"nktspfr-rozpochala-rehuliuvaty-ta-nahliadaty-za-novymy-finansovymy-ustanovamy","status":"publish","type":"post","link":"https:\/\/www.nssmc.gov.ua\/en\/nktspfr-rozpochala-rehuliuvaty-ta-nahliadaty-za-novymy-finansovymy-ustanovamy\/","title":{"rendered":"The NSSMC has begun to regulate and supervise new financial institutions"},"content":{"rendered":"<p>From July 1, 2020, the National Securities and Stock Market Commission (NSSMC) began to perform the function of regulation and supervision in the system of accumulative pension provision, regulation and supervision of financial and credit mechanisms and property management in construction and real estate transactions.<\/p>\n<p>After the transition to regulation and supervision of the NSSMC from July 1, 2020, participants of the non-banking financial services markets&nbsp; will continue to adhere &nbsp;the legislation introduced during the operation of the \u0435he National Commission for State Regulation of Financial Services Markets.&nbsp; The licenses for property management services to finance construction and\/or real estate transactions and licenses for services in the accumulative pension system in the administration of non-state pension funds will be considered as reissued in accordance with this legislation.<\/p>\n<p>On July 1, 2020, the NSSMC adopted a Res\u043elution <a href=\"https:\/\/www.nssmc.gov.ua\/document\/?id=10667159\" target=\"_blank\" rel=\"noopener noreferrer\">\u2116341<\/a>, according to which managers who manage property to finance construction and \/ or carry out real estate transactions and administrators of the non-state pension funds, the licenses of which are valid as of June 30, 2020, as well as non-state&nbsp; pension funds were included in the respective registers, managed by the NSSMC.&nbsp; This Resolution also establishes a temporary procedure for these entities to submit information (documents) related to changes in data contained in their registration and licensing files.<\/p>\n<p>To ensure the continuity of activities, reporting and supervision, the NSSMC has adopted a number of regulatory legal acts aimed at the succession of functions of state regulation and supervision in the areas transferred to the NSSMC, namely:<\/p>\n<ul>\n<li>&#8220;<a href=\"https:\/\/www.nssmc.gov.ua\/en\/nktspfr-rozrobyla-pershyi-normatyvnyi-akt-shchodo-zvitnosti-upravyteliv-ffb-ta-fon-v-ramkakh-implementatsii-zakonu-pro-split\/\" target=\"_blank\" rel=\"noopener noreferrer\">Regulation on the procedure for compiling and submitting administrative data on the activities of managers to the National Securities and Stock Market Commission<\/a>&#8220;;<\/li>\n<li>&#8220;<a href=\"https:\/\/www.nssmc.gov.ua\/en\/administratory-npf-budut-zvituvaty-pered-nktspfr-po-novomu\/\" target=\"_blank\" rel=\"noopener noreferrer\">Regulation on the procedure for compiling, submitting and publishing administrative data by the NPF administrator, including reporting on non-state pension provision<\/a>&#8220;;<\/li>\n<li><a href=\"https:\/\/www.nssmc.gov.ua\/en\/administratory-npf-ta-upravyteli-fon-i-ffb-rozrakhovuvatymut-prudentsiini-pokaznyky\/\" target=\"_blank\" rel=\"noopener noreferrer\">amendments to the \u201cRegulations on prudential standards of professional activity in the stock market and requirements for the risk management system<\/a>\u201d;<\/li>\n<li><a href=\"https:\/\/www.nssmc.gov.ua\/en\/z-1-zhovtnia-nabyraie-chynnosti-poriadok-pohodzhennia-namiru-nabuttia-abo-zbilshennia-istotnoi-uchasti-u-profuchasnyku-rynku\/\" target=\"_blank\" rel=\"noopener noreferrer\">a new edition of the \u201cProcedure on approval of the acquisition of a substantial shareholding in a professional stock market participant\u201d<\/a>, which will be also applied to the new types of activities in the stock market;<\/li>\n<li><a href=\"https:\/\/www.nssmc.gov.ua\/en\/proects_of_regular\/pro-zatverdzhennia-poriadku-provedennia-perevirok-u-sferi-profesiinoi-diialnosti-na-fondovomu-rynku-rynku-tsinnykh-paperiv-ta-diialnosti-u-systemi-nakopychuvalnoho-pensiinoho-zabezpechennia\/\" target=\"_blank\" rel=\"noopener noreferrer\">draft Procedure for conducting inspections in the area of professional activity in the stock market (securities market) and activity in the system of accumulative pension provision<\/a>;<\/li>\n<li><a href=\"https:\/\/www.nssmc.gov.ua\/en\/proects_of_regular\/pro-vnesennia-zmin-do-polozhennia-pro-sertyfikatsiiu-fakhivtsiv-z-pytan-fondovoho-rynku\/\" target=\"_blank\" rel=\"noopener noreferrer\">amendments to the Regulations on certification of stock market specialists<\/a>;<\/li>\n<li><a href=\"https:\/\/www.nssmc.gov.ua\/en\/proects_of_regular\/pro-zatverdzhennia-polozhennia-pro-poriadok-atestatsii-fakhivtsiv-z-pytan-fondovoho-rynku\/\" target=\"_blank\" rel=\"noopener noreferrer\">Regulations on the procedure for certification of stock market specialists<\/a>.<\/li>\n<\/ul>\n<p>The NSSMC is currently developing a new edition of the Licensing conditions for conducting activities in the securities market, which will be applied to the activities mentioned above.&nbsp; The document is planned to be discussed soon.<\/p>\n<p>Inspections of new participants which perform professional activities in the stock market will start after the state registration of the regulatory legal act that will regulate the procedure for scheduled and unscheduled inspections (approximately September 2020).<\/p>\n<p>All amendments and innovations on regulation of new types of professional activity in the securities market will be discussed with market participants and will be published on the official website of the NSSMC.<\/p>\n<p>It should be reminded that the Law on Split, adopted on September 12, 2019, provided for the division of functions of the National Commission for State Regulation of Financial Services Markets between the National Bank of Ukraine (NBU) and the National Securities and Stock Market Commission (NSSMC).
