The National Securities and Stock Market Commission has approved new rules allowing professional market participants to officially engage external specialists or companies to perform specific tasks (i.e., to outsource services).<\/p>\n
The new rules establish clear requirements: the external service provider must possess sufficient resources, qualified personnel, and an impeccable business reputation. Its area of activity must align with the work entrusted to it.<\/p>\n
This is a significant step toward aligning Ukrainian legislation with EU standards. Transparent rules will enable companies to legally optimize their costs without compromising the interests of investors.<\/p>\n
The core principle of the new requirements is that while companies may engage third-party contractors, they cannot delegate responsibility to them. Even if a company outsources functions such as internal audit or IT, it remains solely accountable to clients and the NSSMC for the final outcome.
