Following public consultations, the Resolution will be submitted to the Ministry of Justice for registration.<\/p>\n<p>Companies will also be required to provide the NSSMC with detailed reports covering not only the software itself but also the country of its registration, the cloud services employed, server locations, system security measures, and the use of automated bots.<\/p>\n<p>Companies must also immediately report hacker attacks, software malfunctions, and the presence of sanctioned software\u2014prohibited by the State Service of Special Communications \u2014within their systems.<\/p>\n<p>This is necessary to enable the NSSMC to monitor compliance with sanctions legislation and the security of financial data, as well as to minimize the impact of any large-scale system failures or cyberattacks.<\/p>\n<p>The previous rules were approved back in 2012; since then, technology has changed significantly (with the advent of cloud computing, mobile apps, large language models (LLMs), and automated bots), rendering the old oversight mechanisms ineffective.<\/p>\n<p>A report must be submitted within 90 days of the new rules coming into effect, and subsequently on an annual basis by February 1. Companies must also notify the NSSMC within one month of any changes to or updates of their software.<\/p>\n<p>Information must be submitted online\u2014either through information agents or directly to the Commission\u2014in the form of XML files certified with an electronic signature.<\/p>\n<p>Comments and proposals may be submitted until July 27, 2026, to the email address of the Information Technology Department of the NSSMC: it@nssmc.gov.ua.<\/p>\n<p>Once the proposals have been processed and finally approved, the Resolution will be submitted to the Ministry of Justice of Ukraine for registration.<\/p>","protected":false},"excerpt":{"rendered":"<p>The National Securities and Stock Market Commission is completely updating the rules governing the oversight of computer programs used by professional market participants.
