To obtain a license for the corresponding type of activity, a legal entity founded by a foreign legal entity and intending to carry out professional activities in the stock market is required to submit the following documents to the NSSMC, in addition to those specified in Part 2 of this Article:
To obtain a license for the corresponding type of activity, the legal entity founded by a foreign individual and intending to carry out professional activities in the stock market must submit to the NSSMC a written permit for the participation of an foreign individual in a professional stock market participant in Ukraine issued by the competent regulatory authority of the state of its permanent residence, if required by the legislation of such state, or a written statement that the legislation of the relevant state has no requirements for obtaining such permit, in addition to the documents specified in Part 2 of this Article.
The documents submitted by a foreign legal entity or individual in accordance with Parts 3-4 of this Article are required to be notarized at the place of issue and legalized according to the established procedure, unless otherwise provided by international treaties ratified by the Verkhovna Rada of Ukraine, provided that the documents in a foreign language must be accompanied by a notarized translation into Ukrainian.
The NSSMC, according to its established procedure, issues or refuses to issue a license for certain type of professional activity in the stock market within three months from the date of receipt of documents.
To check information about foreign legal entities or individuals in the structure of ownership of a legal entity intending to carry out professional activities in the stock market, the period for reviewing documents is six months.
The license is issued after a legal entity submits a copy of the license fee payment document.
The term of the license for a certain type of professional activity in the stock market is unlimited.
Securities of a foreign issuer may be admitted to circulation in the territory of Ukraine exclusively on stock exchanges subject to the following conditions:
To obtain a decision on admission, a foreign issuer is required to submit the following documents to the NSSMC:
The NSSMC decides on admission or rejection to admit within 30 days of the date of receipt of the documents.
