The Committee on Law Enforcement is responsible for the following issues:
devising measures to prevent and stop violations of legislation in capital markets and organized commodity markets;
methodological and methodological support and coordination in matters relating to the consideration of cases of violations in capital markets and organized commodity markets;
taking further action to enforce financial penalties (fines) if the measures taken by a state enforcement officer to locate the debtor’s property have proved unsuccessful;
the expediency of proceeding with the case due to its insignificance;
the expediency of submitting a written statement to a commercial court with claims against the debtor and inclusion in the list of bankruptcy creditors;
the expediency of the filing a petition by the NSSMC (the creditor) with the relevant commercial court to initiate bankruptcy proceedings against a company in accordance with Article 34 of the Bankruptcy Procedures Code of Ukraine;
determining whether the NSSMC should file a lawsuit with the court to liquidate the joint-stock company;
determining whether the NSSMC should apply to the court for the liquidation of a corporate investment fund;
determining whether the NSSMC should apply to the court to terminate a legal entity – issuer (if the issuer is included in the list of issuers showing signs of fictitiousness);
law enforcement procedures relating to critical infrastructure facilities, for which the NSSMC is the sectoral authority in the field of critical infrastructure protection;
consideration of proposals to amend the NSSMC’s regulatory acts on law enforcement issues;
devising and implementing measures aimed at preventing unlawful takeovers and seizures of enterprises;
preventing the use of insider information when conducting transactions in organized capital markets and organized commodity markets.
