The NSSMC (The National Securities and the Stock Market Commission) informs that on February 16, 2023, Resolution No. 153 of February 15, 2023 «Regarding the application of certain Resolutions of the National Securities and Stock Market Commission during the period of martial law» entered into force.

From the date of entry into force of Resolution No. 153, temporarily, for the period of martial law, the NSSMC’s Resolution of October 1, 2015 No. 1597 on Approval of the Regulation on Prudential Standards of Professional Activity on the Stock Market and Requirements for the Risk Management System, registered in the Ministry of Justice of Ukraine, was suspended 28.10.2015 under No. 1311/27756 (as amended), as well as stopping the compilation and submission to the NSSMC by professional participants of capital markets and organized commodity markets of reporting data on the results of calculating prudential standards established by Resolution No. 1597 and the data on the basis of which they were carried out calculation.

Therefore, in accordance with the requirements of Resolution No. 153, the last day for calculating the prudential standards provided for by Resolution No. 1597 is February 15, 2023.

Compilation of reporting data based on the results of calculation of prudential standards provided for by Resolution No. 1597 and their submission to the NSSMC shall be stopped on February 16, 2023.

The reporting data based on the results of calculations of the prudential standards provided for by Resolution No. 1597, which were not submitted to the NSSMC until 15.02.2023 inclusive, must be submitted to the NSSMC after the resumption of compilation and submission of relevant reporting data, which will take place 90 days after the end of martial law. in accordance with paragraph 10 of Resolution No. 153.

In addition, Resolution No. 153 stipulates that cases of violation of the requirements of the legislation on capital markets and organized commodity markets for non-compliance by professional participants in their activities with the requirements regarding prudential standards established by Resolution No. 1597, as well as for failure to submit, failure to submit within the established time limits, and failure to submit in full to the Resolution of the reported data and information on the results of the calculation of such prudential standards and the data on the basis of which their calculation was carried out, which took place before this decision came into force, the NSSMC will not be disturbed, and the proceedings in the relevant cases on the violation of the requirements of the legislation on the capital markets and organized commodity markets, which were disrupted during martial law, are suspended until the resumption of the Resolution No. 1597.

The term of execution of orders to eliminate violations of legislation on capital markets and organized commodity markets for non-compliance with the above-mentioned legislative requirements was also extended for a period of up to 90 days after the suspension of martial law.
