The NSSMC informs: the amendments in the contents and structure of CII and NPF assets have come into force

The NSSMC (National Securities and Stock Market Commission) informs that the amendments to two documents, which regulate the contents and structure of assets of the Collective investment institutions and non-state pension funds have entered into force.

In particular, the Regulator has changed the conditions for acquisition the rights of claim regarding the contents of the assets of the venture capital fund. Now the list of rights of claim is enhanced with the rights of claim under the contracts for investment and financing of construction objects.

The changes also concerned CII assets. Now among other things they consist of:

⁃ funds, including in foreign currency, on current and deposit accounts opened with banking institutions;

⁃ bank grade metal;

⁃ real estate assets;

⁃ securities;

⁃ derivative contracts and other assets authorized by the legislation of Ukraine, taking into account the restrictions for specific types of investment funds.

The venture fund assets may consist entirely of derivative contracts, in particular.

The amendments are provided by the Regulator’s Resolution On the Approval Of Amendments To Certain Normative Legal Acts Of the National Securities And Stock Market Commission (Regarding the Contents And Structure Of Assets) dated 09.09.2021 №746, registered by the Ministry of Justice on the 25^th October of this year. They refer to the following regulatory acts of the NSSMC:

– The Provision On the Contents And Structure Of Assets Of the Collective Investment Institution (dated 10.09.2013 № 1753);
– The Provision On the Requirements For the Individuals Engaged In Professional Asset Management Of Institutional Investors (Asset Management Activities) Regarding the Contents And Structure Of Assets Of Non-State Pension Funds, which they manage (dated 26.04.2012 №582).

The NSSMC brought these documents in compliance with the requirements of current legislation.
